Barack Obama has received significant news concerning the legal standing of one of his key policies, as it has now been declared unconstitutional.
In a recent development, a federal judge issued a ruling that characterized a revised federal policy, which aimed to safeguard hundreds of thousands of immigrants brought to the U.S. as children from deportation, as having legal issues.
However, notably, the judge refrained from an immediate halt to the program, permitting the existing protections for recipients to persist.
U.S. District Judge Andrew Hanen aligned with the position of Texas and eight other states that had initiated legal action against the Deferred Action for Childhood Arrivals (DACA) program.
It is widely expected that this judicial decision will be appealed, ultimately advancing to the U.S. Supreme Court for the third time, where the program’s fate will once more be subject to deliberation.
In his comprehensive 40-page decision, Judge Hanen expressed compassion for the difficulties faced by DACA recipients and their families. Nevertheless, he consistently emphasized the longstanding legal concerns surrounding the program’s foundation.
He articulated his viewpoint, noting, “While recognizing the challenges confronted by DACA beneficiaries and their families, this Court has consistently voiced reservations regarding the program’s legal status.” The judge strongly emphasized that the responsibility for addressing these concerns should lie with the legislative branch, stressing that “The remedy for these deficiencies should be pursued within the confines of Congress, rather than being within the purview of the executive or judicial branches.”
Hanen’s ruling strongly reiterated the fundamental principle that “The Executive Branch should not encroach upon the constitutional authority vested in Congress, even when attempting to address legislative gaps.”
